ARIZONA DEPARTMENT OF ENVIRONMENTAL QUALITY TERMINATION OF CONSENT ORDER

Naco Sanitary District

The Arizona Department of Environmental Quality is hereby terminating Consent Order, Docket No. APP-02-20, issued on July 17, 2020. The Order is being terminated for the following reason(s):

1. On July 19, 2020, documentation of funding sources and contractors to be used to comply with this Order was received by ADEQ.

2. On July 6, 2021 a Standard Operating Procedure (SOP) detailing a maintenance plan including preventative measures to ensure that vegetation is removed from the ponds, pond banks, and pond banks was received by ADEQ.

3. On July 10, 2021, documentation and photographic evidence that the remains of the heavy liner have been removed from the second and third ponds was received by ADEQ.

4. On August 10, 2021 documentation that the fence was repaired was received by ADEQ.

5. On December 12, 2021, documentation that all vegetation (salt cedars, reeds, bottlebrush, mesquites, cattails, and cactus) had been removed from the banks and inside of all four ponds, perimeter, and maintenance road was received by ADEQ.

6. On December 12, 2021, an evaluation and documentation of the integrity of the banks of the ponds and a plan to return the ponds to the permitted conditions within three-hundred sixty-five (365) calendar days of this Order’s effective date was received by ADEQ.
